1.Introduction and acceptance

These Terms of Service (the “Terms”) form a legally binding agreement between you and Artside (“ArtSide”, “we”, “us”), the operator of https://artside.ai.

By creating an account, buying a plan or credits, or otherwise using ArtSide, you confirm that you accept these Terms and our Acceptable Use Policy, and that you have read our Privacy Notice and Cookie Policy.

If you do not accept these Terms, please do not use ArtSide.

These are the current beta-version Terms. They have not yet been independently reviewed by a solicitor; their publication does not by itself mean that ArtSide meets every legal requirement that applies to it.

2.Definitions

  • “Service” means the ArtSide website, studio, gallery, AI Brush editor, print preparation feature, account area and related functionality.
  • “User Inputs” means everything you submit: uploaded photographs and images, prompts, text, instructions, reference images, brush masks and similar material.
  • “Outputs” means images generated, transformed, edited or prepared by the Service in response to your User Inputs.
  • “Credits” means the metered usage units that the Service consumes when you run a generation, edit or print preparation.
  • “Plan” means a free account or a paid subscription described on our pricing page.
  • “MyArtLane” means the third-party printing and framing partner to which ArtSide can hand off an order for physical wall art.

3.About ArtSide

ArtSide is an AI image creation and transformation studio. It currently offers Text to Image, Photo Transformation, Photo to Art, AI Brush editing, a private gallery, image downloads, AI print preparation and an optional handoff to MyArtLane for physical prints and frames.

ArtSide is a digital service. We do not print, frame, sell or deliver physical products — see section 24.

4.Eligibility and age requirements

You must be at least 18 years old to hold an ArtSide account. The Service is not intended for children and we do not knowingly provide it to them.

[REQUIRES BUSINESS DECISION — confirm the minimum age with a solicitor; the current beta policy assumes 18+ because ArtSide is a paid AI image service that accepts photographs of people.]

If we learn that an account holder is under the minimum age, we may suspend or close the account and delete associated content, subject to any records we are required by law to keep.

You must also be legally capable of entering into a contract and must not be barred from using the Service under any applicable law or sanctions regime.

5.Account registration and security

You need an account to generate images. You must provide accurate registration details, keep them up to date and confirm your email address where we ask you to.

You are responsible for keeping your password confidential and for activity that takes place under your account. Tell us promptly if you believe your account has been accessed without your permission.

Accounts are for your own use. Do not share credentials, resell access, or use another person's account.

6.Acceptable use

Our Acceptable Use Policy forms part of these Terms and sets out what you must not create, upload, transform, store or share using ArtSide. Breaching it is a breach of these Terms.

In summary, you must not use ArtSide for unlawful, abusive, deceptive or rights-infringing purposes, and you must not attempt to bypass credits, rate limits, safety controls or other users' privacy.

7.User Inputs: uploaded images, prompts and instructions

You keep whatever rights you already hold in your User Inputs. We do not claim ownership of your photographs, prompts or instructions.

You grant us a non-exclusive, worldwide, royalty-free licence to host, store, copy, transmit, process and display your User Inputs, and to send them to our AI model provider, only so far as is necessary to operate the Service for you, to keep it safe and secure, and to comply with the law. This licence ends when the relevant content is deleted, except for copies we must retain for legal or security reasons.

Uploaded photographs

You must have the rights, permissions and lawful authority needed to upload each photograph or image and to have it processed by AI.

Owning a printed or digital copy of a photograph does not by itself give you the copyright in it, nor the privacy, image or personality rights of the people shown in it. Where a photograph shows other people, you must have any permission required by the law that applies to you.

  • Do not upload images you obtained unlawfully.
  • Do not upload images you do not have permission to process.
  • Do not upload confidential or commercially sensitive material without authority.
  • Do not upload private or intimate images where processing them would breach someone's rights.
  • Do not upload content that is unlawful, or that is prohibited by our Acceptable Use Policy.

Prompts and instructions

You are responsible for the prompts and instructions you submit, including attempts to reproduce a third party's protected work, brand, logo or likeness.

8.AI Outputs and ownership

As between you and ArtSide, and so far as we are lawfully able to do so, we assign to you the rights we hold in the Outputs you generate, subject to these Terms, to third-party rights and to the terms of our AI model provider.

We cannot grant rights that we do not hold. In particular:

  • Whether an AI-generated image attracts copyright at all, and who owns it, depends on the law of the country in question, and the position differs between jurisdictions.
  • An Output may resemble existing works, brands, products or people, and may resemble Outputs generated for other users from similar prompts.
  • We do not guarantee that an Output is original, unique, exclusive, protectable, or clear of third-party copyright, trademark, design, personality, publicity or privacy rights.
  • You are responsible for checking whether an Output is suitable and lawful for your intended use, and for obtaining any clearance that use requires.

You must not remove or falsify any provenance, watermark or metadata that identifies an image as AI-generated where such information is provided.

9.How AI generation works, and its limits

AI image generation is probabilistic. The same prompt can produce different results, and results may not match your intention.

  • Outputs can be inaccurate, distorted, anatomically wrong, or contain unexpected details, text or artefacts.
  • Outputs may reflect biases present in the underlying models.
  • Outputs are not a factual record of anything, and must not be presented as evidence or as a real photograph of a real event.
  • Similar prompts by different users may produce similar images.
  • Safety filters, ours and our provider's, are imperfect: they may refuse acceptable requests and may fail to block every prohibited one.

Nothing produced by ArtSide is professional advice of any kind.

10.Commercial use

Commercial use of Outputs depends on your Plan. The Creator plan currently lists a commercial licence among its features; whether other plans permit commercial use is set out on the pricing page at the time of purchase.

[REQUIRES BUSINESS DECISION — confirm precisely which plans permit commercial use, and whether commercial rights survive downgrade or cancellation. The application does not currently enforce a commercial-use restriction technically.]

Where commercial use is permitted, it remains subject to these Terms. You remain responsible for third-party rights and for any trademark, personality, publicity and privacy clearance your use needs. We do not guarantee exclusivity, copyright protection or commercial suitability.

11.Credits

ArtSide is metered in credits. Credits are usage units, not money, not e-money and not a stored-value instrument. They have no cash value, cannot normally be redeemed for cash, and cannot be sold, transferred or exchanged between accounts unless we expressly allow it.

Current credit costs: a Text to Image image costs 1 credit; a Photo Transformation or Photo to Art image costs 2 credits; a Pro image (Creator and Studio plans only) costs 5 credits in total; an AI Brush edit (Creator and Studio plans only) costs 2 credits; an AI print preparation costs 1 credit. Costs are determined by our servers, and are shown in the studio before you generate.

When credits are taken and returned

Credits are reserved from your balance when a generation, edit or print preparation starts, not when it finishes. If the job then fails, our servers automatically return the reserved credits to your balance. Repeated submissions of the same job are recognised and charged once.

If a print compatibility check finds that your image is already print-ready, no credit is charged for preparation.

Free and promotional credits

New accounts currently receive 10 free credits, granted once per eligible account, which expire 1 month after they are granted. Monthly subscription credits expire 3 months after they are added; annual subscriptions add credits monthly and each batch expires 13 months after it is added. Credit packs expire 12 months after purchase. Free and promotional credits may be limited in amount, time or purpose, and may be withdrawn where they have been obtained through multiple accounts, abuse or error.

Rollover and expiry

Unused plan credits roll over while your subscription remains active, until each batch reaches its expiry date. Monthly plans: each month's credits expire 3 months after they are added. Annual plans also add credits every month (never the whole year upfront); each batch expires 13 months after it is added.

Credit sourceWhen it is addedExpiry
Plan creditsEvery month (monthly and annual plans)Monthly plans: 3 months after they are added. Annual plans: 13 months after they are added.
Free creditsOnce, when an eligible account is created1 month after they are granted
Top-up credits (one-time credit packs)On one-time top-up purchase12 months from purchase
Bonus creditsWhen granted (gifts, promotions and referrals)Referral credits: 12 months after they are granted. Other bonus credits: depends on the grant, shown in Credit balance details.

If your plan is cancelled, all credits will expire on their expiry date.

When you spend credits, the credits closest to their expiry date are used first. Expired credits are removed from your balance automatically and shown in your credit history. New-account welcome credits are bonus credits and expire 12 months after they are granted.

12.Plans, subscriptions and payment

Current paid plans: Hobbyist: £3.99 per month, or £2.99 per month when paid annually (£35.88 per year), including 100 credits per month; Creator: £7.99 per month, or £5.99 per month when paid annually (£71.88 per year), including 200 credits per month; Studio: £19.99 per month, or £14.99 per month when paid annually (£179.88 per year), including 500 credits per month.

Current one-time credit packs: 50 credits for £2.50; 100 credits for £5.00; 200 credits for £9.00.

Prices are shown in pounds sterling on the pricing page and in the checkout before you pay. [INSERT — confirm whether prices are inclusive or exclusive of VAT and how VAT is applied to consumers in different countries.]

Renewal and billing

Subscriptions renew automatically at the end of each billing period (monthly or annual) at the then-current price for your plan, until cancelled. Your billing date is the date your subscription started. Subscription credits are released to your balance for each billing period.

Cancellation and plan changes

You can cancel a subscription at any time from your account area. Cancellation stops future renewals; your plan normally continues until the end of the period you have already paid for. Upgrades, downgrades and any proration are handled by our payment provider at the time of change.

[REQUIRES BUSINESS DECISION — confirm the exact proration, downgrade and end-of-period credit treatment implemented in the billing flow.]

Payment failures

If a payment fails, we may retry it, pause the release of subscription credits, downgrade the account to the free tier or suspend paid features until payment succeeds.

Payment provider

Payments are taken by Stripe. ArtSide never receives or stores your full card details. Payments are currently configured in Stripe test mode — [INSERT — confirm live mode is enabled before taking real payments].

13.Your statutory rights as a consumer

If you are a consumer in the UK, you have rights under the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 that these Terms do not affect. Nothing here is intended to exclude or limit those rights.

Digital content and services we supply must be as described, of satisfactory quality and fit for purpose. If they are not, you may be entitled to a repair, a replacement, a price reduction or a refund, depending on the circumstances.

14-day cancellation

For distance contracts, consumers generally have 14 days to cancel. For digital content supplied immediately, that right can be lost once supply begins with your express request and your acknowledgement that you lose the cancellation right. Where you have started generating images, credits already consumed reflect a service already supplied.

[REQUIRES BUSINESS DECISION — confirm the exact checkout wording and consent used to obtain the customer's express request and acknowledgement, and confirm the refund policy for partly used billing periods and partly used credit packs, with a UK solicitor.]

Consumers in the EU and other countries keep any mandatory rights that apply to them locally.

Refunds

Where we agree a refund, or where one is required by law, we refund to the original payment method. We do not refund credits already consumed by completed generations, except where the law requires it or where the service was faulty.

To request a refund or raise a fault, contact us at [INSERT GENERAL CONTACT EMAIL].

14.Service availability and changes

We aim to keep ArtSide available, but we do not guarantee uninterrupted or error-free operation. The Service depends on third-party infrastructure and AI providers and may be unavailable for maintenance, upgrades or reasons beyond our control.

Features may be labelled beta or experimental. Those features may change, behave unpredictably or be withdrawn.

We may change, add or remove features. If a change materially reduces a paid feature you rely on, we will give you reasonable notice and, where appropriate, the option to cancel.

15.Moderation, suspension and termination

Prompts, uploads and generated images pass through automated safety checks before they are processed, stored or shown. If a check cannot be completed (for example because the safety service is unavailable), the request is refused rather than allowed through unchecked, and any reserved credits are returned. We cannot promise that moderation detects every prohibited image or use.

Automated blocks are recorded and reviewed by our team. A block on its own does not add a strike to your account; strikes and suspensions follow human-confirmed or repeated violations. Credits are handled separately from safety decisions: blocked or failed generations are refunded automatically.

Where we find a breach, or where we reasonably suspect illegal activity or a risk to people or to the Service, we may: issue a warning; block or remove content; refuse a generation; restrict credits or features; suspend the account temporarily; terminate the account; and report the matter to law enforcement where the law requires or clearly justifies it.

You can close your account at any time. We may terminate or suspend an account for material breach, abuse, non-payment, or legal or security reasons.

If you believe an enforcement decision is wrong, contact [INSERT ABUSE REPORTING EMAIL] and we will review it.

Effect of termination

On termination your access to the Service and to stored images ends. Unused credits are lost on termination for breach, and otherwise are treated as set out in section 10. Please download anything you want to keep before closing your account. We retain records we are required or permitted by law to keep — see the Privacy Notice.

16.Intellectual property complaints

You must not use ArtSide to infringe copyright, trademarks, design rights, database rights, moral rights, publicity or personality rights, or privacy rights.

If you believe content on ArtSide infringes your rights, contact [INSERT IP / RIGHTS COMPLAINTS EMAIL] with: your name and contact details; a description of the right you hold and evidence of it; identification of the content complained about; the reason you believe it infringes; and a statement that the information you have given is accurate.

We will review reports, may remove or block content, and may suspend repeat infringers. This is a general rights-reporting process; it is not a claim that ArtSide operates a US DMCA safe-harbour procedure. [REQUIRES BUSINESS DECISION — whether to register a DMCA agent for US users.]

17.ArtSide's intellectual property and feedback

The Service itself — including the software, interface, design, branding, logos, documentation, presets and underlying technology — belongs to us or our licensors. You may use it only as these Terms allow.

You must not copy, modify, reverse engineer, scrape, resell or create derivative works from the Service except to the extent the law expressly permits.

If you send us feedback or suggestions, we may use them freely and without obligation to you. Please do not send us confidential information you do not want us to use.

18.Third-party services and links

ArtSide relies on third parties for hosting, storage and authentication, AI image models, payments and printing. Those services have their own terms and privacy notices, and their availability affects ours.

Where we link to a third-party website, we do not control it and are not responsible for its content. Nothing in this section limits our responsibility where the law does not allow it to be limited.

19.MyArtLane prints and frames

ArtSide supplies a digital service. If you choose to order a physical print or frame, ArtSide hands you off to MyArtLane with your chosen artwork.

The physical product is sold to you by MyArtLane under MyArtLane's own terms, and MyArtLane is responsible for pricing, production, delivery, returns and product quality. ArtSide is not the seller of the physical product.

Information needed to fulfil your request — the artwork and a handoff reference — is shared with MyArtLane, as described in the Privacy Notice. Your delivery and payment details for the physical order are collected by MyArtLane.

[REQUIRES BUSINESS DECISION — confirm the contractual and data-sharing relationship with MyArtLane in writing, including whether any commission, agency or reseller arrangement applies.]

20.Disclaimers

Except for the rights the law gives you that cannot be excluded, the Service is provided as it is. We do not guarantee uninterrupted availability, error-free generation, particular AI results, uniqueness, copyright protection, legal clearance, accuracy, or suitability for a specific commercial or legal purpose.

Nothing in this section affects your statutory rights as a consumer.

21.Limitation of liability

We do not exclude or limit our liability where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, and for your statutory rights as a consumer.

Subject to that, we are not liable for loss that was not reasonably foreseeable when you started using the Service, nor, if you use ArtSide for business purposes, for loss of profit, business, goodwill, opportunity or data.

Subject to the above, our total liability arising out of or in connection with the Service is limited to [INSERT — proposed cap, for example the greater of the amount you paid to ArtSide in the 12 months before the claim and a fixed minimum]. [REQUIRES UK SOLICITOR REVIEW — the cap and its enforceability against consumers and business users must be drafted and reviewed professionally.]

You are responsible for how you use Outputs, including any clearance your use requires.

22.Your responsibility for misuse

If you use ArtSide for business purposes, you agree to indemnify us against claims, losses and reasonable costs arising from your breach of these Terms or the Acceptable Use Policy, or from your User Inputs or use of Outputs.

This indemnity applies only to the extent permitted by law and does not apply to you as a consumer where the law does not allow it.

23.Events outside our reasonable control

We are not responsible for delays or failures caused by events outside our reasonable control, including failures of third-party infrastructure, AI providers or payment providers, network outages, cyber attacks, or acts of government. We will take reasonable steps to limit the effect and to resume the Service.

24.Changes to these Terms

We may update these Terms to reflect changes to the Service, to our providers, or to the law. The version, effective date and last-updated date are shown at the top of this page.

We will give reasonable advance notice of material changes, by email or in the product, before they take effect for you. If you do not accept a material change, you may cancel your subscription and close your account; where a material change disadvantages you mid-term, you may be entitled to a pro-rata refund of a prepaid period.

We will not change the price of a subscription period you have already paid for.

25.General

If any provision of these Terms is found unenforceable, the rest continues to apply. A delay in enforcing a right is not a waiver of it. You may not transfer your rights under these Terms without our consent; we may transfer ours as part of a reorganisation or sale, without reducing your rights.

These Terms, together with the Acceptable Use Policy, Privacy Notice and Cookie Policy, are the whole agreement between us about the Service.

26.Governing law and jurisdiction

These Terms and any dispute arising from them are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction.

If you are a consumer resident elsewhere, you keep the protection of any mandatory laws of your country of residence, and you may be able to bring proceedings in your local courts. Nothing in this section removes those rights.
